TERMS & CONDITIONS

1.1. The following Terms and Conditions apply to all orders placed by the customer (hereinafter referred to as “you”) on https://www.vieribottazziniworkshops.com (hereinafter referred to as “we” or as “Website”).
1.2. We reserve the right to amend these Terms and Conditions without prior notice to you. The version of the Terms and Conditions applying to your order is the one you agree upon at the time you place your order.
2.1. Only persons of legal age can place an order.
2.2. Each submitted order constitutes an offer to purchase services for sale on the Website (herein referred to as “services” or as “workshops”). Orders are subject to our acceptance, and we reserve the right to refuse sale of services, and participation to any workshop, to whomever we please without giving any reasons.
2.3. Order confirmation is merely information that your order has been received. Purchase contract only starts when first payment (either deposit or full fee) has been received and confirmed. Contracts are considered fulfilled by the time full payment has been received, and dates for the supply of services purchased have been set.
2.4. Failure to comply to our scheduled payment deadlines will result in your booking’s cancellation, and in forfeiting any monies paid.
3.1. Prices for services (and eventual special offers) displayed on the Website are valid at the time they occur. Prices for any same services (and eventual special offers) displayed in other stores, catalogues or on other websites and on the Website may differ from each other at any given time. In such case, price displayed on the Website shall prevail.
3.2. We strive to ensure that all pricing details displayed on the Website are correct, and we cannot be held responsible for any printing or spelling errors in pricing display.
3.3. Prices displayed on the website include Italian IVA (Value Added Tax or VAT, 22%).
4. PAYMENT METHODS
Services for sale on the Website can only be paid for using the payment gateways available on the Website at the moment of purchase. Payment gateways and payment providers available on the Website at any given time are provided on an ‘as is’ and ‘as available’ basis.
5. CANCELLING ORDERS
If you change your mind, you may cancel your order at any time. According to Italian law, the Right of Withdrawal does not apply to contracts regulating the supply of services related to leisure and free time such as photography workshops. Therefore, cancelling your order will result in forfeiting any payment made in relation to the order that has been cancelled.
6. MINIMUM ATTENDANCE
Minimum attendance to group Workshops is two participants out of a maximum of three. In case minimum attendance will not be met for a given Workshop, the only applicant will be offered the possibility to turn the selected Workshop into a Workshop One-on-One at a favourable rate: in case this offer will not be accepted, the Workshop will be cancelled and condition (7) below will apply.
7. CANCELLED WORKSHOP
If for any reason we are unable to fulfil your order, such in the case of a workshop’s cancellation, you will be informed as soon as practicable and if any payment(s) for such order has been received, said payment(s) will be refunded to you in full using the payment method you used for your initial purchase or transferred to a different workshop, according to your preference. In case of a refund, bank fees, credit card processor fees and any other similar fees out of our control won’t be refunded. You acknowledge either solution of your choice as full and final settlement.
8. GENERAL LIABILITY LIMITATION
8.1. We do not accept any liability for any damage to your computer system or for any loss of data that may result to you from your use of the Website.
8.2. We do not guarantee which content and services will be available on the Website at any given time. All content and services available on the Website at any given time are provided on an ‘as is’ and ‘as available’ basis.
8.3. We do not guarantee that the Website will be working continuously and perfectly, and we do not accept any liability for any damage that may result to you from interruption of service.
8.4. We do not guarantee that the information on the Website will be free from errors or omissions and while we do not accept any liability for any damage that may result to you from eventual such errors and omissions, we will strive to correct any eventual such errors or omissions as soon as practicable once we are made aware of them.
8.5. We do not accept any liability or any part in any controversies that shall arise between you and the payment providers used by the Website at any given time.
9. WORKSHOP-SPECIFIC LIABILITY LIMITATION
9.1. We do not assume any liability for any error, omission, injury, loss, delay or damage to persons or property arising during the course of a workshop or in transit to and from one from the actions of third party such as, i.e. only and without limitation to, travel agents, airlines, train services, hotel management, restaurant management, car park management, national park service management, visited sites management, law enforcement forces, government agents and so on.
9.2. We reserve the incontestable right to, and we do not assume any liability for, changing a workshop’s daily or general program at any time should conditions dictate it.
9.3. In the event of a workshop’s full cancellation on our part, we do not accept any liability for any other expenses other than the workshop’s fee that you might have incurred, i.e. only and without limitation to, airline tickets, car rentals, hotel reservations, food, passport fees, visa fees, permits and so on. We strongly recommend you purchase refundable airline tickets and make refundable car and hotel reservations if needed; more, we strongly recommend you to always carry personal, travel and camera equipment insurance.
9.4. By submitting an application to one of our workshops, you declare to be physically fit and able to participate in outdoor photographic activities, excursions and field work. You accept to disclose to us any illness or ailments limiting you from taking part in such activities, acknowledge than failure to do so may result in, i.e. only and not limited to, danger, injuries, loss and damages to you personally and to your equipment and release us from any liability resulting from such failure to disclose any illness and ailments to us. You acknowledge that you have read the above information concerning your responsibility in taking part to our activities and you release us from any liability related to damage, injuries, loss to you and/or your propriety caused by taking part in such activities.
9.5. You acknowledge to be responsible for paying your own travel, accommodation and food costs directly, as well as for any other cost not specifically included in each workshop’s “WHAT’S INCLUDED” section. We do not assume any liability nor will act as intermediary between you and any third party should any problem or controversy arise, in case of, i.e. only and not limited to, refunds, cancellations, and so on.
10. BAD WEATHER POLICY
Since we believe that it is always possible to find good images under what people normally considers “bad” weather, workshops will be conducted no matter what the weather conditions are. However, we solely reserve the incontestable right to decide whether not go out on days when the weather conditions are such as to pose danger to people or things, or when we deem the weather to make it absolutely impossible to photograph.
11. FORCE MAJEURE
We are not responsible for any delay or failure to comply with any our obligation under these Terms and Conditions if the delay or failure arises out of events beyond our reasonable control. Such events shall include, i.e. only and without limitation to, failures of infrastructures either physical or informatics, government interventions, wars, civil unrests, hijacking, fires, floods, accidents, storms and/or tornados, epidemics and pandemics, strikes, lockouts, cancelled flights or trains, terrorist attacks, and so on.
11.1. TEMPORARY COVID-19 SPECIAL CLAUSE
Clause 11.1 will be in effect starting January 20, 2022 and until March 20, 2022. Clause 11.1 amends clause 11. FORCE MAJEURE above, in case of events directly related to the COVID-19 pandemic only. Clause 11.1 is valid for Workshops booked before January 20, 2022 and running between January 20, 2022 and March 20, 2022 only. Clause 11.1 replaces and supersedes any previous amendment to our clause 11. FORCE MAJEURE above.
11.1.1 WORKSHOP CANCELLATION. Clause 11.1.1 is valid if, and only if, all three of the following conditions are met: a. We are forced to cancel a group Workshop scheduled to run between January 20, 2022 and March 20, 2022 due to the COVID-19 pandemic; and b. You have booked said Workshop before January 20, 2022; and c. Said Workshop’s payment deadlines have all been respected by you at the time of the Workshop’s cancellation.
220.127.116.11. Under Clause 11.1.1, and in exception to Clause 11. FORCE MAJEURE, we will offer you the option to credit all your cancelled Workshop’s payment(s) minus a 200 euro processing fee towards one or more new Workshops, or ask for a refund of all your cancelled Workshop’s payment(s) minus a 200 euro processing fee. Said credit shall be used under the conditions outlined in clause 11.1.3 below.
11.1.2. IMPOSSIBILITY TO TRAVEL TO THE WORKSHOP. Clause 11.1.2 is valid if, and only if, all seven of the following conditions are met: a. You face an impossibility to travel to a Workshop scheduled to run between January 20, 2022 and March 20, 2022 due to travel being suspended between your country of residence and the country where the Workshop is running; and b. Such impossibility to travel is caused by the COVID-19 pandemic only: any other Force Majeure causes interrupting travel between your country of residence and the country where the Workshop is running will not be covered by this clause 11.1.2; and c. Such impossibility to travel is in effect later than the 14th day before the Workshop’s scheduled start; and d. You have booked said Workshop before January 20, 2022; and e. Said Workshop has been paid by you in full; and f. Said Workshop’s payment deadlines have all been respected by you; and g. The Workshop is regularly running.
18.104.22.168. Under Clause 11.1.2, and in exception to Clause 11. FORCE MAJEURE, we will offer you the option to credit your cancelled Workshop’s payment(s), minus the deposit fee, towards one or more new Workshops. Said credit shall be used under the conditions outlined in clause 11.1.3 below.
11.1.3. CONDITIONS OF USE. The credits resulting from clause 22.214.171.124 and 126.96.36.199 shall be used as follows: a. Your credited amount shall be used against the balance of one or more new Workshop(s) booked after the cancelled Workshop’s starting date; b. Your new Workshop(s) shall be booked within one year of the cancelled Workshop’s starting date; c. Any Workshop running at any time in the future and open for booking on the Website is eligible, provided there is available room; d. Any credited balance left unused past said one year deadline will be forfeited.
13. COPYRIGHT NOTICE
All content, text and images displayed on the Website are protected by copyright and may not be downloaded or used except upon express prior written permission.
14. FINAL PROVISIONS
This website is subject to Italian laws. Competent court is the Tribunale di Milano. Legal language is Italian.
TEN WORKSHOPS, ONE FREE. Booking ten between group Workshop and Workshops One-on-One ONLY, you’ll get a group Workshop’s fee for free (see conditions below):
1. Payment in full of a group Workshop’s fee or a Workshop One-on-One’s fee is necessary and sufficient condition for a Workshop to qualify for the TEN WORKSHOPS, ONE FREE program;
2. Only group Workshops are available as free Workshops;
3. There is only ONE seat available as a free Workshop seat on any given Workshop;
3. Your free group Workshop will include everything that is included in your chosen free group Workshop’s fee, and only what is included in your chosen free group Workshop’s fee;
4. Your free group Workshop will NOT include any other costs and expenses you might incur to attend the Workshop;
5. Your selection of a free group Workshop is subject to availability: i.e., if a Workshop is Sold Out, or if someone else already claimed their free seat on any given Workshop, such Workshop will not be eligible to you as a free Workshop;
6. No ICELAND group Workshops are eligible as free group Workshops;
7. Your free group Workshop will include only your own personal free group Workshop’s fee; eventual non-photographing spouses or partners’ fees will not be included, and will be calculated as usual;
8. Workshops purchased with special offers (such as pre-booked Workshops, Workshops offered at a discount, etc.) do not qualify for the TEN WORKSHOPS, ONE FREE program.
